<p>Manslaughter is an all-encompassing terminology that involves multiple independent levels of gravity, which depends on the crime. Generally speaking, manslaughter is a faulty manner of slaying a person with no plan or purpose. A criminal action is considered as manslaughter when the evidences that are presented by the offender prove that the killing was not intentional. Manslaughter is a severe case but relatively not as much of murder.</p>

Every year, DUIs affect thousands of people in the United States, so it is helpful to know some of the facts and statistics about DUIs in order to realize how serious their nature is. A DUI is defined as driving with a blood alcohol limit of over .08, but a law enforcement officer&#8217;s evaluation of a driver, such as their speech, driving, and roadside sobriety test performance can be sufficient for a DUI charge.</p>
<p>In 2008, DUIs accounted for some 13,000 deaths on American roads; this represents about 37 percent of all driving-related fatalities. However, drunk driving deaths have been on the decline since 1982, when about 26,000 people died each year from DUIs. This year, over 10,000 people are expected to die from DUIs; that&#8217;s about one person every 50 minutes. The three states with the highest number of fatalities related to DUIs are Texas, California, and Florida.</p>
<p>Drunk driving affects all Americans; they cost every adult in the country about $500 each year. In total, drunk driving has been estimated to cost taxpayers between $21 billion and $24 billion annually. One in three people will be involved in an alcohol-related crash in their life, and every year, about 708,000 people are injured in the over 2 million alcohol-related accidents that occur.</p>
<p>DUIs are generally due to a small group of repeat offenders. About 7 percent of drivers are responsible for two-thirds of all DUIs. The average person caught for a DUI has driven drunk over 80 times before an arrest. This is because only one person is caught for a DUI for every 200 to 2,000 drunk drivers on the road. Between 7 pm and 3 am, roughly one out of every ten drivers is impaired by alcohol. Since the risk of an accident goes up about 6 times when a person is at the legal limit for alcohol intoxication, this means that driving gets much more dangerous at these times.</p>
<p>Not all people arrested for a DUI are automatically guilty. Errors in police observation and faulty breathalyzer results can sometimes lead to the arrest of individuals that were not driving while impaired. For this reason, it is always important to consult a DUI lawyer in the event of being arrested for drunk driving.</p>

<p><strong> Causes of Cerebral Palsy</strong></p>

While it is the result of a disruption in the development of the brain, the trigger in each individual case may remain a mystery. However, certain factors have been identified as possible triggers, of which include:</p>

• Syphilis<br />
• Cytomegalovirus, a common viral infection with symptoms similar to flue<br />
• Environmental toxins, including methyl mercury</p>
<p>If a newborn contracts viral encephalitis, bacterial meningitis, or severe jaundice, the illness may increase his risk of developing Cerebral Palsy.</p>
<p>Babies born more than three weeks early, who are delivered in the breech position, or who weigh five and one-half pounds or less face increased risks. The more premature the baby is, the greater his risk of developing Cerebral Palsy.</p>
<p>In the case of a multiple birth, the risk factors increase in proportion to how many babies shared the womb. If one baby dies, the surviving infants may face a higher risk of Cerebral Palsy.</p>
<p><strong> Symptoms of Cerebral Palsy</strong></p>
<p>Symptoms can vary a great deal between patients. Certain difficulties may affect only one limb or one side of the body, or the entire body may be affected. However, some of the most common symptoms include:</p>
<p>• Tremors, lack of coordination, or muscle spasms<br />
• Muscles that are too flaccid or too tight<br />
• Delayed motor development, such as crawling or sitting alone<br />
• Displaying a propensity to use the limbs on one side over the other<br />

<p>After an offer has been made and it becomes a binding agreement, the following procedures may need to be done:</p>

<li>Conduct a home inspection. It&#8217;s customary to have a home inspection to evaluate the structural integrity of a house. A licensed inspector will conduct a detailed analysis of the condition of the home and prepares a report detailing his or her findings. Based on the inspection results, the buyer can choose to request for improvements to be done prior to closing day.</li>
<li>Get an appraisal.  An appraiser will inspect the home and verify if it is worth much more than the purchase price.</li>
<li>Secure title insurance and a home insurance. This can protect the buyer and the lender from physical property damage and from future prior ownership claims that may arise.</li>
<li>Title Search &#8211; The title company will conduct a search of legal records in order to identify if the seller has the legal right to transfer ownership of the property.<strong></strong></li>

Signs and symptoms vary and the severity of the injury is based on what part of the brain is affected or the severity of the impact. Traumatic brain injuries require immediate medical condition and needs emergency care.</p>

<li><strong>Blunt Trauma.</strong> Brain injuries due to blunt trauma may not be as visible as those seen in penetrating head injuries. Patients may suffer from decreased brain functions and loss consciousness before they are finally sent for medical attention. They are often more dangerous than penetrating head injuries because precious minutes are lost before treatment is finally administered to the patient.</li>

This facilitated the natural production of brain chemicals (monoamines) such as serotonin, norepinephrine and histamine. These chemicals are mood regulators and can also increase learning ability. This study concluded that REM sleep deprivation may help patients suffering from clinical depression since this situation will reflect the activity of <em>selective serotonin reuptake inhibitors </em>(SSRIs). But it should be noted that while sleep that occurs outside of REM sleep may repair brain cell damage initiated by free radicals, the complete lack of sleep will damage the enzymes, themselves. This was the first study that demonstrated the relationship between sleep deprivation and brain damage in laboratory rats. Animal studies have also shown that sleep deprivation increases levels of stress hormones.</p>
<p style="text-align: left;">In 2005, a study was conducted which demonstrated that a group of rats that had been deprived of REM sleep for 5 days did not show an effect on their ability to recover from inflicted wounds, when compared to a group of non-REM deprived sleep subjects.</p>
<p style="text-align: left;">Although there are several related effects of sleep deprivation, the most significant consequence is <em>loss of attention</em>. Attention deficit can take the form of forgetfulness, when performing routine tasks. An example of this would be forgetting to add an ingredient when preparing a meal to forgetting to activate a turn signal, when driving a vehicle. This can literally translate into a life-or-death scenario which may involve a construction or traffic accident that may come about as a result of sleep deprivation.</p>
<p style="text-align: left;">These effects are studied by using a test known as the <em>psychomotor vigilance task</em>. In this test, the researcher will require the test subject to press a button when a light is activated, at seemingly random intervals. Errors are recorded when the subject has failed to press the button when the light stimulus was activated. These missed opportunities are attributed to instances of <em>micro-sleeps</em> which will manifest as a result of sleep deprivation.</p>

While claims can be based on other causes, such as intended harm or strict liability, negligence is almost always present, at least in part, in a personal injury case.</p>
<p><strong>What is negligence?</strong></p>
<p>Negligence occurs when a person fails to act like an “ordinary, reasonable person” would have in a certain situation (i.e. the one that caused the injury). Of course, the terms “ordinary” and “reasonable” make negligence a rather broad term. What one may consider a reasonable reaction may be considered irresponsible or negligent by another. In a personal injury trial, the jury establishes negligence based on each party’s arguments and the evidence at hand.</p>
<p><strong>Elements of negligence</strong></p>
<p>For negligence to be proven, the case must satisfy four main elements: duty, breach, causation, and damages. First, the person being sued must have owed a duty to the other party, whether through a contract or general law. Next, he or she must have breached this duty, which in turn should have caused the injury. It must be proven that the injury was the result of the negligent act and not by other circumstances, such as hazards on the premises or a preexisting medical condition. Finally, the suing party must have sustained physical, emotional, or mental damages as a result of the injury.</p>
<p><strong>Intentional and unintentional negligence</strong></p>
<p>A person can breach his or her duty to another either accidentally or on purpose. This distinction is important because it defines the type of negligence committed, or whether it was committed at all. If a person simply fails to fulfill his obligations, the act is simply considered negligent. However, if the act was intentional or reckless—that is, the person knew the consequences of the act and did it anyway—he or she may be charged with gross negligence.</p>
<p><strong>Damages and negligence</strong></p>
<p>When negligence is proven, the injured party is entitled to damages—money paid to compensate for the losses and suffering caused by the act. Damages can be classified as general, special, and punitive. General damages refer to intangible suffering, such as fear and emotional distress. Special damages are those that are quantifiable, such as lost income. Punitive damages are awarded when the negligence is proven to be malicious or intentional.</p>

<p><strong>The Healthy Brain</strong></p>
<p>The best way to understand the physiology of an injured brain, would be to know what makes up a healthy brain and how it functions. The brain matter is soft and encased inside the skull which serves as a protective covering. The brain tissue, itself, is made up of nerve cells (neurons) that form pathways throughout the brains. These pathways carry electric-based information which determines our actions and thoughts. These actions will also include involuntarily functions such as metabolism, heart rate and breathing. Our senses (hearing, taste, vision, touch, smell) are also functions of our brain.</p>
<p>While the brain is necessary to control and maintain the body’s functions, the most complex thing that our brain deals with is our behaviour and personality. When these are affected, the way in which the person relates to others and the outside world can be unalterably changed.</p>
<p><strong>The Injured Brain</strong></p>
<p>Should a brain injury occur, the affected portion of the brain can involve a change in the functions of nerve tracts and neurons can impede their ability to carry necessary messages that will tell the individual’s brain what it should do. This may alter the injured person’s ability to think or interfere with basic body functions such as body temperature regulation and bladder and bowel control. This can cause impairment ranging from slight to a complete inability to function. This may lead to the need for long term care that can involve lifetime hospitalization. In some cases, the patient may need to be placed on life support equipment.</p>
